TUBESCA-COMABI 70TH ANNIVERSARY COMPETITION RULES

FROM 1 OCTOBER 2024 TO 15 DECEMBER 2024

Article 1: Subject

TUBESCA-COMABI (SIRET no. 42248183800023), a simplified joint stock company with capital of 6,393,200.00 euros, registered on the Bourg-en-Bresse Trade and Companies Register under number 422 481 838, whose registered office is located at 976 Route de Saint-Bernard, Lieu-dit Fétan, 01600 Trévoux, is organising a free competition, from 1 October to 15 December 2024 at 11:59 pm, with no obligation to purchase, under the conditions set out in these rules (hereinafter the ‘Organising Company’).

Article 2: Eligibility for the competition — Entry conditions

This free competition with no purchase obligation is open to all natural persons over the age of 18, with the exception of members of the Organising Company’s staff and any person directly or indirectly involved in its organisation or execution, as well as their spouse/cohabitant and members of their family: ascendants and descendants, brothers and sisters.

There may only be one entrant per household (same surname, same postal address).

The Organising Company reserves the right to ask any entrant to provide proof of these conditions. Any person who does not meet these conditions or refuses to provide proof of them will be banned from the competition and, if they win, will not be entitled to the prize.

It is specified that a natural person may only win once.

Article 3: Competition terms

To enter the competition, entrants must:

  1. Buy an MP PRO step stool (3 to 7 steps) during the competition period.
  2. Fill in the entry form with the information requested (surname, first name, e-mail address, telephone number) via the QR code shown on the product.

The entrant’s entry will be considered complete and valid if all 2 points above are met.

Any entry that is incomplete or that contravenes these rules will be considered null and void.

Entry in the competition implies full and unreserved acceptance of these rules in their entirety.

Any form of fraud or attempted fraud, such as creating false identity information in order to enter more than once, will be declared null and void. The Organising Company reserves the right to disqualify from the competition any person who does not comply with these rules.

Article 4: Entry period and end of the competition

The competition will run from 1 October to 15 December 2024 at 11:59 p.m.

The competition will be closed once the winner has been drawn in the presence of a Court Enforcement Officer and has received their prize.

Article 5: Designation of winners and publication of results

In order to determine the competition winner, a draw will be made by the Organising Body on 18 December 2024 from among the complete and valid entries.

Any entry containing a false declaration or an erroneous and/or incomplete declaration and/or not complying with these Rules, drawn at random, will be considered null and void and will result in another entrant being designated by a new draw. The new draw will take place as described in this article.

Article 6: Prizes

The following prizes will be awarded for the entire Competition:

3 stays of one night and 2 days for 4 people.

Accommodation:

One night’s stay at Disney’s Newport Bay Club 4* hotel, in a standard room for four people, including at least one adult.

Access to the Parks:

Access to both Disneyland Paris parks (Disneyland Park and Walt Disney Studios Park) for the duration of your stay.

The prize-winners will have to propose three choices of dates for the stay, which they will submit by e-mail to the address indicated by Tubesca-Comabi at the time of notification of the prize. Booking requests must be made at least one month before the desired date of arrival. The date of the stay is subject to availability at Disney’s Newport Bay Club hotel.

The stay cannot be booked during the following periods:

Transport not included

The prize is nominative and may not be awarded to anyone other than the winner. Identification (national identity card or passport) will be required.

The prize described above may not be returned or exchanged for other objects or services, irrespective of their value, and may not be exchanged for cash or by cheque. If the winner is unwilling or unable to take possession of their prize, they will not be entitled to any compensation whatsoever.

The Organising Company reserves the right to replace these prizes with other prizes of equivalent value and characteristics, for any reason whatsoever, without being held liable in this respect.

The Organising Company shall under no circumstances be liable if the contact details do not correspond to those of the winner, are incorrect or incomplete or if the winner remains unavailable.

Winners residing in French overseas departments and regions (DOM-TOM) or on the African continent will be able to choose an equivalent prize to the Disney holiday. This equivalent prize will take the form of a credit of equivalent value to the initial prize (i.e. €1,000), which can be used on the lastminute.fr website. LThe credit will enable the winners to book a travel offer, a stay, or an accommodation service of their choice from among the options available on the lastminute.fr platform.

Article 7: Delivery or withdrawal of the prize

The winner will be contacted by e-mail at the address given at the time of entry within 7 days of the draw.

The winner must confirm their acceptance of the prize within 7 days of receiving the e-mail, failing which they will be deemed to have forfeited their prize.

Article 8: Free entry

No financial consideration or cost in any form whatsoever will be claimed from entrants as a result of their entry. No costs incurred for entry in the competition via the Internet will be reimbursed, including any connection costs.

Article 9: Use of personal data

The information you provide to us as part of this competition is necessary to manage your entry and distribute the prize. In accordance with the General Data Protection Regulation (GDPR), we inform you that this information may be used by Tubesca-Comabi for direct marketing purposes, to send you promotional communications, information about our products and services, and special offers for a period of 3 years from our last contact with you or until you unsubscribe from receiving such communications. By entering this competition, you expressly consent to this use of your data. You may at any time exercise your rights of access, rectification, deletion and objection to the processing of your personal data by contacting us at the following address: contact@tubesca-comabi.com.

In accordance with the applicable regulations, entrants have various rights with regard to the collection and processing of their personal data. They may request access to or the rectification or deletion of their data. Where appropriate, they may also object to or request the restriction of the processing of such data, and they also have the right to the portability of their data. Any natural person can set directives concerning the fate of their data after their death, and register them with trusted third parties certified by the CNIL. These rights may be exercised directly by post to the Organising Company’s address mentioned in Article 1. The maximum response time to a right being exercised is one month.

Article 10: Liability

The Entrant acknowledges and accepts that the sole obligation of the Organising Company within the framework of the competition is to submit the complete and valid entries collected to the draw, provided that their entry complies with the terms and conditions of these Rules, and to award the prize to the winner(s), in accordance with the criteria and procedures defined in these Rules.

The Organising Company shall not be held liable, without this list being exhaustive, for any technical, hardware or software failure of any nature whatsoever, the risks of contamination by any viruses circulating on the network and the lack of protection of certain data against possible misappropriation.

Entry in the competition implies knowledge and acceptance of the characteristics and limits of the Internet in terms of technical performance and response times for consulting, querying or transferring information.

Article 11: Force majeure/reservations

The Organising Company shall not be held liable if, due to a case of force majeure or event beyond its control, the competition has to be modified, shortened or cancelled.

The Organising Company reserves the right to carry out any checks it deems useful, relating to compliance with the Rules, in particular to disqualify any entrant who has made an inaccurate, misleading or fraudulent declaration.

Article 12: Disputes – Applicable law

The Rules are governed by French law. The parties shall endeavour to amicably resolve any dispute arising from the interpretation or performance of these Rules . If the disagreement persists, it will be referred to the competent courts.

Any dispute or claim relating to the competition must be made in writing to the address of the Organising Company given in Article 13 of these Rules. No disputes will be considered eight days after the end of the competition as defined in Article 4.
